TERMS OF USE

The terms and conditions below (“Terms of Use”) describe the rules applicable to the use of the electronic soccer games (“Games”), and provided by HERMIT CRAB GAME STUDIO LTDA, enrolled with the CNPJ/MF under the nº 13.202.241/0001-65, with registered office at Rua Benjamin Constant, 648/302, Caçapava do Sul/RS, Zip Code 96570- 000, Brazil (“HERMIT CRAB”) to a user duly registered in the Game (“You”).

By using the Game, you state that you have read and agree to these Terms of Use. If You do not agree, do not install or use the HERMIT CRAB Game.

1. Account
1.1. The Game is an application in which You need to register and create an account to access and use the Game (“Account”).

1.2. You must have a valid email address and provide true and accurate information.

1.3. You agree to provide true, accurate, current, and complete information about yourself.

1.4. You are responsible for maintaining confidentiality and for all activities that may occur in your Account. If You or someone using your Account violates these rules and fails to remedy such violation after a notice, HERMIT CRAB may take action against You, including suspending or terminating your Account. In case of serious breaches, HERMIT CRAB may take legal action without prior notice. Some examples of serious violations include, but are not limited to: promotion, encouragement or involvement in hacking, sale of accounts or rights (including currencies and virtual items) without the permission from HERMIT CRAB, harassment or threat of illegal activity. When possible, HERMIT CRAB will notify you of the action it will take in response to the violations of this instrument.

1.5. You may cancel your Game Account at any time, at a particular place within the Game or by clicking HERE.

2. Under Aged

2.1. To create your Account, You must be at least 13 (thirteen) years old (or other minimum age applicable in your country of residence). If You are between 13 (thirteen) and 18 (eighteen) years old, You and your parents or guardians must review this Terms of Use together.

2.2. Parents and/or legal guardian are responsible for acts of minors under the age of 18 (eighteen) years old when using the Game. HERMIT CRAB recommends that parents and/or legal guardians familiarize themselves with parental control on the devices they provide to their children and adolescents.

2.3. If you are a parent or legal guardian, HERMIT CRAB recommends that you monitor your children’s online activities and make sure your children never disclose their personal data without your prior consent.
2.4. Parents or guardians can disable their Children’s Account at any time by creating a parental account or by sending an email to [email protected].

2.5. We reserve the right to request written proof of consent from a parent or guardian for any Game user that we suspect to be an under aged. Parental consent applies exclusively to the Game. In addition, HERMIT CRAB may request documents that prove the identity of the user, parent or guardian.

3. Access

3.1. HERMIT CRAB reserves the right to deny access to the Game of any user, including You, that violates these Terms of Use.

3.2. HERMIT CRAB may cancel, as part of the use of the Game, any registration related to You, at any time and without prior notice, once it has knowledge that You have performed any act or conduct that (a) violates Brazilian law; (b) contradict these Terms of Use; or (c) violate the principles of morality and good manners, in a manner that would subject you to appropriate civil and criminal penalties.

3.3. HERMIT CRAB is the owner of all content, information and infrastructure contained in this Game (including, without limitation, messages, data, information, texts, photographs, graphics, videos, maps, icons, software, codes, or other material). You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell, or resell any information, software, products or services obtained from or through this Game.

3.4. You agree not to:

a) violate any law, rule or regulation;

b) use this Game and its content for any commercial purpose;

c) access, monitor or copy any content or information of this Game using any type of robot, spider, scraper or other automated means or any manual process for any purpose, without the prior written permission from HERMIT CRAB;

d) violate the restrictions in any header exclusion of robots in this Game or circumvent other measures applied to prevent or limit access to this Game;

e) carry out any action that imposes or may impose, at HERMIT CRAB’s discretion, an unjustifiable or disproportionately large load on the Infrastructure of the Game;

f) establish deep links with any part of this Game for any purpose, without the prior written permission from HERMIT CRAB;

g) frame, mirror or incorporate any part of the Game in any other Game without the prior written permission from HERMIT CRAB;

h) attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any computer program used by HERMIT CRAB related to the Game;

i) harass, threaten, intimidate, embarrass, send spam or otherwise do to another Game user, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc. The hate speech is strictly forbidden;

j) Impersonate another person or imply falsely that You are an employee or representative of HERMIT CRAB.

3.5. If you find another user who is violating any of these rules, please report this activity to HERMIT CRAB by email: [email protected]

4. Responsibility Exemption

4.1. You hereby exempt HERMIT CRAB, as well as its representatives, agents and employees, from any liability relating to the acts, errors, omissions, declarations, warranties, falsehoods, pornography, breaches or negligence or in any way related to the access and use of the Game by You, assuming, exclusively, the responsibility for any damages caused to third parties, and excluding HERMIT CRAB from any judicial or administrative action for this purpose.

4.2. HERMIT CRAB shall not be liable for any activities that may be conducted by under aged people without the permission of their parents or legal guardians. If You are a parent or legal guardian and grant your permission for your son and/or your daughter to play the Game, You agree to these Terms relating to the use of the Game by your child.

4.3. HERMIT CRAB shall not be liable for damages or losses suffered by You as a result of a fortuitous event or force majeure or the breach of security measures by third parties that use, irregularly or criminally, public networks, the Internet or any other technological means to violate systems and illegally access said data.

4.4. HERMIT CRAB shall have the right to modify, suspend or terminate the use of the Game, with or without prior notice, at any time and shall not be liable for any consequences arising from this act.

5. Game availability and updates

5.1. HERMIT CRAB does not warrant that the Game will always be available in all locations or at any time or that it will continue to offer the Game for any specific period of time. HERMIT CRAB does not warrant that the Game may be accessed on all devices, through a specific Internet or connection provider, or in all geographic locations.

5.2. HERMIT CRAB, without prior notice, may need to update, change or reset certain parameters to balance the Game. These updates and/or redefinitions may cause setbacks in Game availability and may affect characters, scenarios, and other elements of the Game.

6. Intellectual Property

6.1. HERMIT CRAB grants You a personal, limited, non-transferable, revocable and non-exclusive license to play the Game, which You have access to for your non-commercial use, subject to the provisions hereof. You may not copy, modify or distribute the Game unless expressly authorized by HERMIT CRAB or permitted by law. You may not reverse engineer or attempt to extract or use the source code or other data in the Game unless expressly authorized by HERMIT CRAB or permitted by law. HERMIT CRAB or its licensors own and reserve the intellectual property rights associated with the Game.

7. Amendments of the Terms of Use

7.1. HERMIT CRAB reserves the right to change these Terms of Use, at any time and without notice, by making available the updated version of the Game. Your use of the Game, after any change to the Terms of Use, will imply your consent and acceptance.

8. Applicable Law and Forum

8.1. This Term shall be governed by the laws of the Federative Republic of Brazil.

8.2. Any claim or controversy between You and HERMIT CRAB will be submitted to the Forum of the City of São Paulo, SP.

8.3. The clarifications regarding the Game and this Terms of Use will be provided by specialized professionals through the email [email protected].

THESE TERMS OF USE ARE APPLICABLE ONLY TO THE EXTENT AUTHORIZED BY LAW.

ANY USE OF THE GAME INVOLVES THE UNRESERVED APPROVAL OF THESE TERMS AND THE PRIVACY POLICY OF HERMIT CRAB.
